Overflow, LLC, a Kansas limited liability company (“Overflow,” “we,” “our,” or “us”), operates an interactive photo booth experience that allow individuals to send photos to themselves via SMS. This Privacy Policy explains how we collect, use, and protect information in connection with that experience.

1. Nature of the Service

The photo booth allows users to:

• Take a photo voluntarily
• Enter their mobile number
• Receive a one-time SMS containing their photo

We do not use this system for ongoing marketing communications.

You will receive one SMS message containing your requested image.
We do not send recurring or promotional messages.

2. Information We Collect

When you use the photo booth, we may collect:

• The photo you choose to capture
• Your mobile phone number
• Message delivery metadata (timestamp, carrier status)
• Location (if applicable)

We do not require account creation.

3. How We Use Information

We use collected information solely to:

• Deliver your requested photo via SMS
• Operate and maintain the functionality of the booth
• Maintain limited technical logs for system reliability and fraud prevention

We do not:

4. No Ongoing Marketing

Your participation in the photo booth does not enroll you in any recurring messaging program.

We do not send promotional or marketing SMS messages unless you separately opt in through a different process.

The booth captures photographic images that may include faces.

• We do not use facial recognition technology.
• We do not scan or analyze facial geometry.
• We do not collect, create, or store biometric identifiers.
• We do not use photos to identify individuals.
• Images are treated solely as user-generated photographs.

6. Minors

The booth may be used by minors.

Overflow does not use or publish images of minors captured through the booth for marketing, advertising, or promotional purposes.

If an image clearly depicts a minor and is stored temporarily for delivery purposes, it is not used for commercial reuse.

If a parent or guardian requests deletion of an image, we will comply within a reasonable timeframe.

7. Publicity & Use of Images

For adult participants, Overflow may request separate consent for promotional or campaign use of images.

Any such use:

• Requires affirmative agreement
• Is governed by a separate written release
• Does not apply automatically by using the booth
• If no separate publicity consent is provided, the image is used only for SMS delivery and system operation.

8. Data Retention

We retain data only as long as reasonably necessary to:

• Deliver the requested photo
• Ensure system functionality
• Maintain limited compliance logs

In general:

• Phone numbers are not retained for marketing purposes.
• Images are not actively monitored or reused unless separate consent is obtained.
• System logs are periodically purged in the ordinary course of business.
• We aim to minimize long-term storage wherever feasible.

9. Data Sharing

We use service providers solely to operate the SMS delivery system, including:

• Twilio Inc. (SMS infrastructure)

Service providers process data only on our behalf and are not permitted to use it independently.

We do not sell personal information.

10. Security

We implement reasonable administrative and technical safeguards to protect information during transmission and storage.

However, no electronic system can be guaranteed to be completely secure.

11. Your Rights

You may request:

• Deletion of your photo
• Removal of associated phone number records (if retained)
